Terms of use

These terms cover the tondi website and the tondi app for macOS. By downloading or using tondi, you agree to them.

Who you are dealing with

tondi is made and operated by Alex Gosselin, a sole proprietor based in Ontario, Canada. Contact: [email protected].

Your licence to use tondi

tondi is licensed to you, not sold. You get a personal, non-exclusive, non-transferable licence to install and use the app on Macs you own or control, for personal or commercial work, for as long as you comply with these terms.

A full licence agreement is included inside the app, in its legal folder, and it governs if the two ever disagree.

You may not resell, rent out or redistribute tondi itself, remove its notices, or present it as your own product. You may not attempt to reverse engineer the app — except where the law gives you that right regardless, and except in respect of the open-source components described below, whose own licences expressly permit it.

Your videos and your clips

Your footage is yours. tondi processes it entirely on your Mac and we never receive it, so we claim no rights of any kind over your videos, your transcripts or the clips you export.

You are responsible for having the right to use the footage you process. Do not use tondi to make clips from material you have no permission to use, or for anything unlawful.

Open-source components

tondi includes FFmpeg, licensed under the GNU Lesser General Public Licence version 2.1 or later. FFmpeg's source is available from ffmpeg.org. The full notices for FFmpeg and every other third-party component are included with the app, and nothing in these terms limits the rights those licences give you.

What tondi does not promise

In plain terms: which moments tondi picks are chosen by a scoring system, not human judgement, and how good the results are depends on your footage — especially how clear the speech is. Transcription is automatic and will sometimes be wrong. Check your clips before you publish them.

We also do not promise that the app is free of defects, that it will run without interruption, or that it will remain compatible with every future version of macOS.

Keep your own backups

tondi writes clips to a folder you choose, and its History and settings live on your Mac. Keeping backups of your work is your responsibility. We cannot recover anything, because we never have a copy.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for lost profits, lost footage or lost work, arising from your use of tondi.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you may have rights under consumer protection law that these terms cannot override, and nothing here affects them.

Payments

tondi is currently free and there is nothing to buy. If paid subscriptions are introduced, terms covering price, billing, cancellation and refunds will be published here before that happens.

Ending the licence

You may stop using tondi at any time by deleting it. Your licence ends if you materially breach these terms. The sections on liability, your content and governing law survive the licence ending.

Changes to these terms

These terms may change as tondi changes. The date at the top will be updated when they do, and continuing to use tondi after a change means you accept the revised terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory laws of your own country.
